Central Motor Vehicles Third (Amendment) Rules, 2022

NOTIFICATION

New Delhi, the 23rd February, 2022 G.S.R. 153(E).—Whereas, the draft rules further to amend the Central Motor Vehicles Rules, 1989 were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 287(E), dated the 23rd April, 2021, in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Official Gazette containing the said notification were made available to the public;

And, whereas, copies of the said Official Gazette in which the said notification was published were made available to the public on the 26th April, 2021;

And, whereas, the objections and suggestions received from the public in respect of the said draft rules have been duly considered by the Central Government;

Now, therefore, in exercise of the powers conferred by sections 41, 50 and 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:-

1. Short title and commencement.- (1) These rules may be called the Central Motor Vehicles (Third Amendment) Rules, 2022.

(2) Save as otherwise provided in these rules, they shall come into force on the date of their publication in the Official Gazette.

2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as the said rules), in rule 112, after sub-rule (8), the following sub-rule shall be inserted, namely:-

“(9) On and after six months from the date of commencement of the Central Motor Vehicles (Third Amendment) Rules, 2022, Special Purpose Vehicle, viz. Cash Vans shall comply with the requirements stated in AIS-163:2020, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 2016(11 of 2016).”.

3. In the said rules, in rule 125-G, after sub-rule (6), the following sub-rule shall be inserted, namely:-

“(7) On and after six months from the date of commencement of the Central Motor Vehicles (Third Amendment) Rules, 2022, Special Purpose Vehicle, viz. Cash Vans, manufactured by Original Equipment Manufacturers, shall comply with the requirements of AIS-163, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016).”.

4. In the said rules, in Form 22 F, for the words, figures and brackets, “[(See rules 47B (3),112(3), 112(4), 112(5), 112(6), 112(7), 112(8),126)]”, the words, figures and brackets, “[(See rules 47B (3),112(3), 112(4), 112(5), 112(6), 112(7), 112(8), 112(9),126)]”, shall be substituted.
