No. S.O.107/H.A.10/98/S.14/98. - In pursuance of the provisions contained in sub-section (4) of section 14 of the Haryana-Electricity Reform Act, 1997 (hereinafter referred to as said Act), the Governor of Haryana hereby grants a provisional licence to Haryana Vidyut Prasaran Nigam Ltd. (hereinafter referred to HVPN) to distribute and supply electricity in retail in the State of Haryana on the following terms and conditions :
- HVPN shall be entitled to exercise all rights, powers and functions which were hitherto exercised by the Haryana State Electricity Board subject, however, to the directions of the State Government and subject to the provisions contained in sections 13, 14 and 15 of the said Act.
- HVPN shall comply with the requirements of and be entitled to exercise all the rights and powers under the Indian Electricity Act, 19 10 and the Electricity (Supply) Act, 1948 to the extent they are applicable under the provisions of the said Act. HVPN shall adhere to the Indian Electricity Rules, 1956, in carrying out its functions under this licence.
- The provisional license shall be in force for a period of six months or up to the time commission established under the said Act communicates the decision to HVPN regarding grant of licence, whichever is earlier.
- HVPN shall, upon the establishment of the commission, place the provisional licence before it which shall be deemed to constitute an application by HVPN for the issue of a regular licence.
- HVPN, as licences, shall have all the powers for the placing of appliances and apparatus for the transmission of electricity, that a telegraph authority possesses under section 10 of the Indian Telegraph Act, 1885, with respect to the placing of telegraph lines and posts for the purposes of a telegraph established or maintained by the Government or to be so established or maintained.
- For distribution and supply of electricity in retail the HVPN shall be entitled to recover charges from various categories of consumers as per tariff Schedule at Annexure.
- The State Government may, at any time during the term of the licence by notification, assign this licence to another company wholly owned by the State Government.
- In the case of difficulty in implementing any of the conditions of this licence, the State Government, on receipt of representation from the licencee may relax the operation of the conditions to the extent considered necessary.
- Contravention of licence conditions shall be subject to the provisions of parts XII and XIII of the said Act.
