No.S.O.108/H.A.10/98/S.14/98. - In pursuance of the provisions contained in sub-section (4) of Section 14 of the Haryana Electricity Reform Act, 1997 (hereinafter referred to as said Act), the Governor of Haryana hereby grants a provisional licence to transmit and supply electricity in bulk to Haryana Vidyut Prasaran Nigam Ltd. (hereinafter referred to is HVPN) in the State of Haryana on the following terms and conditions :

  1. HVPN shall be entitled to exercise all rights, powers and functions which were hitherto exercised by Haryana State Electricity Board subject, however, to the directions of the State Government ,and subject to the provisions contained in sections 13, 14 and 15 of the said Act.
  2. HVPN shall comply with the requirements of and be entitled to exercise all the rights and powers under the Indian Electricity Act, 19 10 and the Electricity (Supply) Act, 1948 to the extent they are applicable under the provisions of the said Act. HVPN shall adhere to the Indian Electricity Rules, 1956, in carrying out its functions under this licence.
  3. The provisional license shall be in force for a period of six months or upto the time the Commission established under the said Act communicates the decision to HVPN regarding grant of license, whichever is earlier.
  4. HVPN shall, upon the establishment of the Commission, place the provisional licence before it shall be deemed to constitute an application by HVPN for the issue of a regular license.
  5. HVPN, as licensee shall have all the powers for the placing of appliances and apparatus for the transmission of electricity, that a telegraph authority possesses under section 10 of the Indian Telegraph Act, 1885 with respect to tile placing of telegraph lines and posts for the purposes of a telegraph established or maintained by the Government or to be so established or maintained.
  6. For transmission and bulk supply of electricity the HVPN shall be entitled to recover charges from various categories of consumers as per the tariff Schedule at Annexure.
  7. The State Government may, at any time during the term of the license, by notification, assign this license to another company wholly owned by the State Government.
  8. In the case of difficulty in implementing any of the conditions of this licence, the State Government, on receipt of representation from the licence may relax the operation of the conditions to the extent considered necessary.
  9. Contravention of licence conditions shall be subject to the provisions of parts XII and XIII of the said Act.
