August 12,2017:
Apex Court granted leave to challange the new rules as and when notified by the Government.
Supreme Court has refused to interfere with Madras HC's stay order on provisions of Centre's May 23 notification banning the sale and purchase of the cattle from the markets for slaughter.
Apex Court, however, modified its earlier order and vacated its stay on the Prevention of Cruelty to Animals Act (Case Property Animals Rules 2017).
Case Property Animals Rules 2017 notified by Centre on May 23,2017 could be implemented now with Supreme Court vacating its stay.
Apex Court Bench comprising of CJI Khehar and Justice Chandrachud expounded that,"We are disposing of petition before us. Stay order of the Madras HC on the Rules (22) b (iii) and 22 (e), Prevention of Cruelty to the Animals (Livestocks Markets) Rule 2017, will remain as it is. We are not touching that".
Court, has granted the liberty to the aggrieved parties to approach Court, when the new rules are notified by Govt. stating that only then, fresh cause of action will arise.
Additional Solicitor General P S Narasimha submitted that Government is looking into objections from the various stakeholders and the rules are under the scrutiny after which it will be tabled in the Parliament.
On July 11,2017, the Supreme Court had extended to the entire country Madras HC's order staying May 23,2017 notification of Centre banning the sale and purchase of the cattle from the markets for slaughter.
Centre had on May 23,2017 issued notification banning the sale and purchase of the cattle from the animal markets for the purpose of slaughtering.
