April 18,2018:

Law Commission has recommended Centre to bring Board of Control for Cricket in India (BCCI) under purview of Right to Information (RTI) Act.

Commission has rejected the argument that the Indian cricket Board was a ‘private body’.

Law Commission in its report titled as ‘Legal Framework: BCCI vis-a-vis Right to Information Act’ has stated that BCCI should be declared a public body.

In January 2018, Law Commission Chairman, Justice BS Chauhan, had called for the BCCI to be brought under the act.

Justice Chauhan had stated that,“BCCI should be under the RTI Act. They get a lot of government grants in terms of tax exemptions and land at concessional costs from the public exchequer.”

Justice RM Lodha panel had also recommended overhaul of Indian Cricket Board and Justice Mukul Mudgal, who headed the panel that investigated the spot-fixing controversy in the 2013 Indian Premier League, had called for the BCCI to come under the RTI.

In July 2016, the Supreme Court had asked the commission to recommend whether the cricket board can be brought under the RTI Act.

BCCI officials have been opposed to sports body coming under the RTI.
