“We don’t even approve wife who is well educated but is sitting at home as housewife” Delhi High court to MBA husband demanding maintenance.

On Thursday, Delhi High Court dissented the Petitioner Husband seeking Maintenance from his wife.

Division Bench of HC comprising of Acting Chief Justice Gita Mittal and Justice C. Hari Shankar was hearing a petition filed by Gaurav Arora who stated himself to be burdened under litigations by his wife Kumkum Sharma for 8 long years.

The couple got married in December 2008 and separated just 7 months after the marriage. Following which the wife filed a number of cases against him. Petitioner submitted that he requested his wife to atleast club the matters but no avail.

He said that he lives in Jhansi and had to travel from Jhansi to Delhi several times every month for eight years due to pending litigation and because of this he lost his job, his source of livelihood.

Hence, he demanded maintenance from his wife who is working in private sector in Bangalore.

Acting Chief Justice Gita Mittal observed that, “Pendency of Litigation is like having Cancer!”

When Acting Chief Justice Gita Mittal enquired about his educational qualification and last job position, he answered that he is an MBA who served as Relationship Manager in the Human Resource Department in Aditya Birla Group.

The bench dissented the Petitioner Husband seeking Maintenance from his wife by categorically stating that, “We do not even support wife who is well educated but is sitting at home as housewife.”

“So don’t tell us that you have lost your source of livelihood because of these litigations and you need maintenance,” bench made it clear.

Bench further told the Petitioner that he being an MBA could have earned livelihood, if not by a full-time job, then by giving tuition classes.
