Liability, in cases of leakage of question paper “necessarily has to be absolute” the Delhi High Court has noted, on Wednesday.

It dismissed the petition of a school in Bawana area whose affiliation was cancelled by the Central Board of Secondary Education (CBSE) in June this year.

Justice C Hari Shankar said usage of unfair means in examinations has taken the “character of organised crime” and refused to quash the CBSE order.

However, the court allowed Mother Khazani Convent School management to once again approach CBSE and explain their defence so that the board, if it deems fit, can review the earlier penalty on the school for leak of Class XII economics paper.

HC noted that “usage of unfair means in examinations, taken on a national level, has, with the passage of time, metamorphosed into an octopus, the tentacles of which spread far outside the examination hall.”

It noted that, “Vyapam wounds are still raw and festering, and do not promise to heal at any foreseeable distance of time. In a time and age when results in examinations have literally become an issue of life and death, an attitude of zero tolerance, in cases where usage of unfair means is suspected, is the pressing need of the hour.”

On April 1, Delhi Police arrested two teachers of this private school in Alipur in northwest Delhi along with the economics tutor of a private coaching centre for their involvement in the leak of economics paper.

The two teachers — Rishabh Antil and Rohit Vats — had allegedly opened the economics question paper two hours before

the exam on March 26, photographed it and sent it to Touquir, a tutor at a local coaching centre, who forwarded it to his students.

The location code in the corner of the leaked paper helped police identify the school to which the paper had been sent.

Relying on the police probe, HC stressed that “purity of the educational system has, at all costs, to be maintained and nurtured” and pointed out that there exists “a live possibility of the paper having been leaked after it had reached the petitioner-school.”
