January 21,2019:

Recently, Centre rejected 11 names recommended by Supreme Court Collegium for appointments as High Court judges.

Centre was of the view that "adverse material" against the persons was found who's names were recommended before Justice Ranjan Gogoi became CJI, for appointment as Judges in Allahabad HC, Jammu and Kashmir HC and Punjab and Haryana HC.

The objections were considered by Collegium, comprising CJI Gogoi, Justice A K Sikri and Justice S A Bobde, on January 16,2019.

The Collegium accepted the objections in all but one case, in which it sought information from Government on the specific charges levelled against a person recommended to be appointed as judge of J&K HC.

In two cases, one each for Allahabad HC and J&K HC, Collegium decided that names would not be processed further, which means their chances of getting recommended again stands obliterated.

Collegium recorded that proposals for their appointment as High Court judges “need not be processed further”.

Government’s objections convinced Collegium to send back to Punjab and Haryana HC for reconsideration names of seven advocates who were recommended by the HC on November 24, 2017, for appointment in High Court.

Considering the material afresh on January 16, Three-member Collegium led by CJI Gogoi stated that, “We have carefully scrutinised the material on record as well as the observations made by the department of justice (law ministry) in the file. Having regard to all relevant factors and the material on record, the collegium is of the considered view that the proposal for elevation of seven advocates deserves to be remitted to the Punjab and Haryana high court.”
