May 17,2018:

At 2 AM on Thursday, Supreme Court Bench comprising of Justice AK Sikri, Justice SA Bobde and Justice Ashok Bhushan  convened to hear the petition seeking stay on the swearing in of BS Yeddyurappa as Chief Minister of Karnataka.

Apex Court Bench refused to stay the swearing ceremony of BS Yeddyurappa as Chief Minister of Karnataka.

SC Bench pointed out that that swearing will be subject to the outcome of petition filed by Congress and JD (S) leaders.

Bench has also directed Yeddyurappa to produce the letters informing Karnataka Governor Vajubhai Vala of his party’s majority in the state.

After Three and Half Hours of Marathon hearing, the order was rendered by the Bench at around 5:30 am.

Senior Advocate Abhishek Manu Singhvi appeared on behalf of the Petitioners, and Attorney General KK Venugopal and Senior Advocate Mukul Rohatgi, appeared on behalf of Centre and Yeddyurappa.

Governor Vala had invited Yeddyurappa to form Government in Karnataka after which the opposition parties made a rush to the Supreme Court.

Registry officials and subsequently Chief Justice of India Dipak Misra in view of urgency of the plea as Yeddyurappa’s swearing in as Chief Minister was scheduled to take place at 9 AM on Thursday, May 17.

However, despite the best efforts of Singhvi, the Court refused to set aside, let alone stay the order of the Governor. Regardless of this fact, the issue seems to be far from resolved. Yeddyurappa is required to produce on the next date of hearing on Friday, the letter submitted to the Governor, which will reveal where things stand.
