JUDGMENT:

Mr. Rajeshwar Indani, learned counsel representing

Mr. P.S.Rajasekhar, learned counsel for the appellant.

Mr. B.Sravan Kumar, learned Assistant Government

Pleader for Services-I, appears for respondent No.1.

Mr. Koya Prabhakar Reddy, learned Standing Counsel

for Nizam Institute of Medical Sciences appears for

respondent Nos.2 and 3.

2. The present appeal is directed against the order

dated 28.06.2023 passed in W.P.No.31749 of 2022 by the

learned writ Court. The appeal suffers from a delay of 732

days, for condonation of which I.A.No.1 of 2025 has been

preferred.

3. Learned counsel for the appellant has taken us

through the averments made in I.A.No.1 of 2025 and

submitted that the appellant was subjected to full body

check-up as a patient of Blood Pressure and Diabetes.

Therefore, he could not file the instant appeal within time.

4. Learned Standing Counsel for respondent Nos.2

and 3 has filed a counter affidavit by strongly opposing the

prayer and submits that there is no cogent explanation for

such an inordinate delay.

5. Having considered the submissions of learned

counsel for the parties and after going through averments

made in the instant I.A., we do not find any sufficient cause

for condonation of such a huge inordinate delay of 732 days

in filing the appeal on account of the plea of medical grounds

that appellant was subjected to full body check-up as a

patient of Blood Pressure and Diabetes and is on regular

check-up.

6. Therefore, the delay condonation petition is

dismissed. Consequently, Writ Appeal is also dismissed.

Miscellaneous applications pending, if any, shall stand

closed. There shall be no order as to costs.
