                    WRIT APPEAL No.482 of 2025

JUDGMENT (Per the Hon'ble the Acting Chief Justice Sujoy Paul):

Sri Dominic Fernandes, learned counsel represents

Sri Abhinav Krishna Uppaluri, learned counsel for the

appellants; Sri K. Laxmaiah, learned Standing Counsel for

Manikonda Municipality, for respondent Nos.2 and 3 and Sri G.

Ravi, learned counsel for respondent No.4.

2. With the consent, finally heard.

3. During the course of hearing, learned counsel for the

parties reached to a consensus and agreed that in W.P.No.10378

of 2025 filed by the present appellants assailing the order dated

18.03.2025, the course open to the learned Single Judge was

either to allow the writ petition or to dismiss it. Similarly, for the

purpose of interim relief, the course open to the learned Single

Judge was either to grant stay against that order or reject the

same. Learned Single Judge was not justified in directing

implementation of order dated 18.03.2025 in a writ petition filed

by the present appellants. Thus, it is agreed that said order may

be set aside and the matter may be directed to be heard afresh

by the learned Single Judge.

4. In view of the consensus arrived at, the impugned order

dated 15.04.2025 in W.P.No.10378 of 2025 is set aside. The

appellants are free to press their interim relief before the learned

Single Judge. Learned Single Judge is requested to rehear the

parties on the aspect of interim relief and pass order afresh.

5. With aforesaid and without expressing any opinion on

merits of the case, this Writ Appeal is disposed of. No costs.

Interlocutory applications, if any pending, shall also

stand closed.
