               WRIT PETITION No.9459 of 2018
ORDER:

This writ petition is filed seeking the following relief:

"to issue Writ of Mandamus or any other appropriate Writ, Order or direction, declaring the inaction of the respondents in considering the case of the Petitioners for providing all notional and service benefits on par with the other Junior Plant Attendants appointed in terms of the Judgment in W.P.No. 23439/1999 and batch and C.C.No.1527/2001 and batch and to declare the same a illegal, arbitrary and violative Articles 14 and 16 of the Constitution of India..."

2. This Court while admitting the writ petition on 22.03.2018

passed the following interim order in I.A.No.1 of 2018:

"Having regard to the facts and circumstances, without expressing any opinion on merits, there shall be interim direction to the competent authority/1st respondent, to consider the representation of the petitioners dated 02.02.2018 and dispose of the same in accordance with law."

3. When the matter is taken up, Ms. Priyanka Singh, learned

counsel representing Mrs. K. Udayasri, learned Standing Counsel

for respondent Corporation, submits that pursuant to the interim

order dated 22.03.2018, the 1st respondent-Chairman and

Managing Director, passed orders vide Memo dated 04.05.2018.

A copy of the Memo is placed on record. The result portion of

Memo dated 04.05.2018 reads as follows:

"Keeping in view of the position stated above, the petitioners in W.P.No.9459/2018 are hereby informed that pursuant to the orders of the Hon'ble High Court

dated 06.09.2000 in W.P.No.23439/1999 and Batch; Judgment dated 29.06.2001 in C.C.No.110/2001 & Batch; and Judgment dated 18.04.2002 in C.C.No.1527/2001 & Batch, the selections made to the post of Junior Plant Attendant in the month of January,2000 as per the notification dated 02.02.1999 were reviewed and orders were issued for appointing the eligible candidates as JPAs from time to time prospectively and none of them were appointed on par with the JPAs appointed in the month of January,2000 as per the notification dated 02.02.1999. They are also informed that about 441 candidates were appointed as JPAs including the petitioners in W.P.No.9459/2018 as against 222 posts of Junior Plant Attendants notified on 02.02.1999. Therefore, they are not entitled for retrospective appointment as Junior Plant Attendant either on par with the candidates appointed as JPAs in the month of January,2000 as per the notification dated 02.02.1999 or on par with Sri P.Rambabu & others for the reasons stated supra.

In view of the above, the communications of this Memo shall be deemed that the request of petitioners have been considered and examined in pursuance of the interim orders dated 22.03.2018 in I.A.No.01/2018 in W.P.No.9459/2018 of the Hon'ble High Court of Judicature at Hyderabad for the State of Telangana and the State of A.P. and the orders of the Hon'ble High Court are implemented in their entirety."

4. Learned counsel further submits that the petitioners

challenged the Memo dated 04.05.2018, by filing W.P.No.35532

of 2018, however, the writ petition was subsequently withdrawn.

5. No representation for the petitioners.

6. Considering the submission made by learned counsel

Ms. Priyanka Singh, and in view of the orders passed by the 1st

respondent-Chairman & Managing Director, vide Memo dated

04.05.2018, in pursuance of the interim order dated 22.03.2018

passed by this Court in this writ petition, this Court is of the

considered view that no further orders are required in this writ

petition.

7. Accordingly, the Writ Petition is closed. No costs.

Miscellaneous petitions pending, if any, shall stand closed.
