(per Hon'ble Sri Justice P.Sam Koshy)
Heard Ms. Sahiti Eadala, learned counsel representing
Mr. S.Ravi, learned Senior Counsel for the petitioners and
Ms. B. Sapna Reddy, learned Senior Standing Counsel for the
Income Tax Department for respondent Nos.1 and 2. Perused the
record.
2. The issue involved in the instant writ petition stands already
covered by the decision of the Hon'ble Supreme Court in the case
of ARUN KUMAR vs. UNION OF INDIA1. Recently also, the
same issue came up before the Division Bench of the Bombay
High Court in the case of ALL INDIA CENTRAL BANK
OFFICERS FEDERATION AND ANOTHER vs. UNION OF
INDIA, THROUGH THE COMMISSIONER OF INCOME
TAX (JUDICIAL) 2 wherein also relying upon the decision of the
(2007)1 SCC 732
2025 SCC Bombay Online 128
Hon'ble Supreme Court in Arun Kumar (supra), a batch of writ
petitions have been dismissed by the Division Bench of the
Bombay High Court.
3. Given the fact that the matter already stands adjudicated by
the Hon'ble Supreme Court and also by the other High Courts, we
are inclined to adopt the view taken by the Bombay High Court,
following the judgment of the Hon'ble Supreme Court in Arun
Kumar (supra).
4. The present writ petition, in the facts and circumstance of
the case, stands dismissed. There shall be no order as to costs.
Consequently, miscellaneous petitions pending, if any, shall
stand closed.
