ORDER:

This Writ Petition is filed seeking a Writ of Mandamus to

declare the action of the respondents, particularly respondent

No.4 - Station House Officer, Paloncha, in not considering the

representation of the petitioners dated 28.03.2022, as illegal and

arbitrary, and consequently, sought a direction to the

respondents, particularly respondent No.4 - Station House

Officer, Paloncha, to grant police protection to the petitioners and

their family members along with plot owners of the said land to

an extent of Ac.1-00 gts. in Sy.No.435, and an extent of Ac.3-34

gts. in Sy.No.437, total admeasuring an extent of Ac.4-34 gts.

situated at Paloncha Revenue village, Paloncha, Bhadradri-

Kothagudem District, belonging to petitioner No.1 herein and land

to an extent of Ac.0-33 gts. in Sy.Nos.434 and 435, situated at

Paloncha Revenue village, Paloncha, Badradri-Kothagudem

District, in the Office of the Sub-registrar, Paloncha, belonging to

petitioner No.2

2. Heard Sri M. Kiran Reddy, learned counsel for the

petitioners, as well as the learned Assistant Government Pleader

for Revenue appearing for respondent Nos.1 to 3, and also the

learned Assistant Government Pleader for Home appearing for

respondent Nos.4 to 6. Perused material available on record.

3. Learned counsel for the petitioners submitted that petitioner

No.1 is the owner and possessor of land to an extent of Ac.1-00

gts. in Sy.No.435 and an extent of Acs.3-34 gts. in Sy.No.437,

total admeasuring an extent of Acs.4-34 gts., having purchased

the same through registered Sale Deed vide Document bearing

No.639/1991, situated at Paloncha Revenue village, Paloncha,

Badradri-Kothagudem District; petitioner No.2 is the owner and

possessor of land to an extent of Ac.1-26 gts. situated at Paloncha

Revenue village, Paloncha, Badradri-Kothagudem District, having

purchased the same through registered Sale Deed bearing

Document No.5143/2019 and also an extent of Ac.0-33 gts. in

Sy.Nos.434 and 435, situated at Paloncha Revenue village,

Paloncha, Badradri-Kothagudem District, having purchased the

same through registered Sale Deed bearing Document

No.1930/2019. Learned counsel for the petitioner further

submitted that there are civil disputes pending in respect of the

subject lands between the petitioners and unofficial respondent

Nos.7 to 11. Learned counsel further submitted that petitioner

No.1 herein and the vendor of petitioner No.2 have filed suits

O.S.No.374 of 2010 and O.S.No.375 of 2010, respectively, on the

file of Principal Junior Civil Judge, Kothagudem, seeking

perpetual injunction against unofficial respondent No.7 herein

and others and the same are decreed vide judgment and decree

dated 25.03.2015 in favour of petitioner No.1 and vendor of

petitioner No.2. Inspite of the same, since unofficial respondents

are threatening the petitioners to dispossess them from the

subject lands, the petitioners claim to have submitted a

representation dated 28.03.2022 to respondent No.4 - Station

House Officer seeking protection to their lands as well as to their

person and the same is still pending consideration. Therefore,

learned counsel for the petitioners seeks a direction to respondent

No.4 to take appropriate action on the said representation dated

28.03.2022 in accordance with law.

4. Taking into consideration the above facts and circumstances

of the case, this writ petition is disposed of directing respondent

No.4 to consider the said representation dated 28.03.2022

submitted by the petitioners and pass appropriate orders in

accordance with law, within a period of six (6) months from the

date of receipt of a copy of this order. No order as to costs.

5. As a sequel, miscellaneous petitions pending, if any, shall

stand closed.
