Judgment

The appellant-original petitioner's petition came to be

dismissed in limine by impugned judgment dated 16.03.2021. The

main ground for dismissal was that the petitioner had challenged

his non-selection by a panel and also challenged the

composition/constitution of the panel after participating in the

process and more importantly the petitioner did not join the

person who was selected and appointed. Thus, on the ground of

participation in the process as well as on the ground of non-

joinder of the necessary party, the petition came to be dismissed.

Learned counsel for the appellant submitted that the

appellant was willing to join the selected candidate as party-

respondent but no opportunity was granted by the learned Single

Judge. The impugned judgment does not record that any such

request was made by the petitioner nor any such pleading is made

in the appeal.

In the result, the appeal is dismissed.
