The matter comes up for consideration of application

Nos.1/2019 and 1/2021 seeking disposal of the instant writ

petition in terms of the judgment dated 10.8.2018 passed by the

Division Bench of this Court in D.B. Civil Special Appeal (W)

No.1122/2017 (Bharti Upadhyay Vs. State of Rajasthan &

Ors.). Another application No.1/2020 is also preferred seeking

preponement of the date of hearing.

Learned counsel for the respondents is not in position to

dispute the fact that the controversy involved in this writ petition

is squarely covered by the judgment dated 10.8.2018 passed in

Bharti Upadhyay's case (supra).

Keeping in view the fact that the D.B. Civil Special Appeal

(W) No.1022/2013 preferred on behalf of the State has already

been dismissed by the Division Bench of this Court vide judgment

dated 7.9.2018, the instant writ petition is allowed in terms of the

judgment dated 10.8.2018 passed in Bharti Upadhyay's case

(supra).

The applications No.1/2019, 1/2020 and 1/2021 are

disposed of.
