Learned counsel for the parties have submitted that the

impugned order dated 14.05.2018 passed by the learned Single

Judge has already been set aside by the coordinate Bench of this

Court in D.B. Special Appeal Writ No.173/2019 (The Rajasthan

State Industrial Development and Investment Corporation Ltd. &

Anr. Vs. Jawari Lal Jain & Ors.) and other connected appeals vide

judgment dated on 06th July, 2020.

The appeal is barred by 151 days and an application under

Section 5 of the Limitation Act has been filed.

The 151 days' delay in filing the present special appeal is

condoned and the application under Section 5 of the Limitation Act

is disposed of.

T/he present appeal is also allowed in terms of the judgment

dated 06th July, 2020 passed by this Court in D.B. Special Appeal

No.173/2019. The impugned order dated 14.05.2018 passed by

the learned Single Judge in S.B. Civil Writ Petition No.10497/2017

is set aside.
