Learned counsel for the petitioner after having attempted to

argue the matter for some time feels advised not to press the

instant Criminal Misc. Petition with liberty to file an appropriate

(2 of 2) [CRLMP-3519/2021]

application under section under section 156 (3) of Cr.PC before the

concerned Magistrate in the light of the judgment rendered by the

Hon'ble Supreme Court in the case of Sakiri Vasu vs. State of

U.P. & Ors. AIR 2008 SC 907.

Accordingly, the Criminal Misc. petition is dismissed as not

pressed with liberty as aforesaid.

The stay petition also stands disposed of accordingly.
