1. Learned counsel for the petitioner submits that the petitioner

has been transferred outside the Assembly area and the same

cannot be said to be in administrative exigency, particularly when

the place where the petitioner is posted has not been indicated.

2. Learned counsel relies upon the judgment passed in his own

case on 20.01.2020 and submitted that notwithstanding the fact

that earlier transfer order dated 29.09.2019 which suffered from

the same infirmity has been quashed by this Court, the

respondents have passed identical orders.

3. Issue notice. Issue notice of stay application also, returnable

within six weeks.

                                   4.   Meanwhile,   effect    and      operation        of      the   order   dated

23.07.2021, qua the petitioner shall remain stayed.
