This bail application has been filed under Section 439 Cr.P.C.

in connection with FIR No.44/2021 registered at Police Station,

Nagori Gate, Jodhpur for offence under Section(s) 341, 323 & 365

of IPC.

Heard learned counsel for the petitioner as well as learned

Public Prosecutor and perused the entire material available on

record.

Learned counsel for the petitioner submits that the other co-

accused who were not named in the FIR have already been

granted bail by the trial court. Learned counsel submits that his

case is not distinguished from that of other co-accused who have

been granted bail by the trail court.

Learned Public Prosecutor has opposed the bail application.

I have considered the submissions and find that the FIR is

belated and there appears to be over implication, but without

commenting further on merits of the case, I deem it just and

proper to enlarge the petitioner on bail.

Therefore, this bail application is allowed and it is ordered

that the accused petitioner - Bharat Lohar S/o Baldev Ram, be

released on bail under Section 439 Cr.P.C. in connection with

aforesaid FIR provided the petitioner furnishes a personal bond of

Rs.20,000/- with one surety in the like amount to the satisfaction

of the concerned Magistrate with the stipulation that he shall

comply with all the conditions laid down under Section 437(3)
