HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR D. B. Special Appeal (Writ) No. 197/2021

In

S. B. Civil Writ Petition No. 8366/2020

APPELLANT:

Versus RESPONDENTS:

1. The State of Rajasthan, through the Secretary Department of Agriculture, Government of Rajasthan, Secretariat, Jaipur.

5. The Secretary, Rajasthan Subordinate and Ministerial Service Selection Board, Jaipur.

For Appellant : Mr. Moti Singh Advocate.

HON'BLE MRS. JUSTICE SABINA HON'BLE MR. JUSTICE VINIT KUMAR MATHUR

Judgment

27/07/2021

Appellant has filed the appeal challenging order dated

18.01.2021 passed by the learned Single Judge, whereby, writ

petition filed by the appellant was dismissed.

Learned counsel for the appellant has submitted that

the appellant had acquired decree of divorce on the date, she

appeared in the written examination, i.e. 03.03.2019. Hence,

(2 of 2) [SAW-197/2021]

case of the appellant was liable to be considered in the category of

divorcee candidates.

Appellant had applied for the post of Agriculture

Supervisor in pursuance to Advertisement dated 25.05.2018.

Certain posts were reserved for divorcee candidates. Appellant

applied under the category of divorcee and filled in her on-line

application form on 17.07.2018. Last date for filling up the

application forms was 03.08.2018. However, decree of divorce

was passed in favour of the appellant on 1.12.2018.

Thus, till the last date for submission of application

forms, appellant was not having a decree of divorce in her favour

and consequently, her candidature could not be considered in

divorcee category. Appellant was not having the eligibility criteria

to apply in divorcee category.

In these circumstances, learned Single Judge rightly

dismissed the writ petition filed by the appellant as the appellant

could not be considered in divorcee category as she was not

having a decree of divorce in her favour till the last date for

submission of application forms, in pursuance to Advertisement

dated 25.05.2018.

No ground for interference is made out.

Dismissed.
