18/08/2021 The present bail application has been filed under Section 439

Cr.P.C. The petitioner has been arrested in connection with FIR

No.273/2021 registered at Police Station Sewar District Bharatpur

for the offence(s) under Section(s) 143, 323, 354(क), 506 & 342

of IPC and later on for offence under Sections 323, 325, 341, 354,

354(ए), 506, 34 of IPC.

It is contended by learned counsel for the petitioner that he

has falsely been implicated in this case. With regard to his criminal

antecedents, learned counsel submitted that in another criminal

case, he has been convicted under Sections 341, 323 & 447 IPC

and extended benefit of probation by the learned Sessions Court

vide its judgment dated 05.11.2019. He submits that the

petitioner is in custody for more than four weeks, investigation as

against him is complete, offences are triable by Magistrate and

prayed for his release on bail.

Learned Public Prosecutor assisted by the learned counsel for

the complainant opposing the bail application submitted that in

view of gravity of allegation against the petitioner, he does not

deserve indulgence of bail.

Taking into consideration the submissions advanced by

learned counsels for the respective parties, the nature of

allegation against the petitioner, his length of custody, the

material contained in the case diary and offences being triable by

the Magistrate; but, without expressing any opinion on the merits

of the case, this Court deems it just and proper to enlarge the

petitioner on bail.

Accordingly, the bail application is allowed and it is directed

that accused-petitioner Ajeet Singh @ Kanha S/o Shri

Vijendra Singh shall be released on bail under Section 439

Cr.P.C. in connection with afore-mentioned FIR registered at

concerned Police Station, provided he furnishes a personal bond in

the sum of ₹1,00,000/- (Rupees One Lac only) together with two

sureties in the sum of ₹50,000/- (Rupees Fifty Thousand only)

each to the satisfaction of the trial court with the stipulation that

he shall comply with all the conditions laid down under Section

437(3) Cr.P.C.
