1. Petitioner has filed this second bail application under Section

439 Cr.P.C.

2. F.I.R. No.539/2019 was registered at Police Station Hindauli,

District Bundi for offence under Section 302 I.P.C.

3. It is contended by counsel for the petitioner that petitioner

has remained in custody for a period of one year and ten months.

Co-accused Najma has been given benefit of bail by co-ordinate

Bench. It is also contended that majority of the witnesses have

been examined.

4. Learned Public Prosecutor has opposed the second bail

application. It is contended that when the bail application was

rejected, statements of material witnesses were recorded and

were considered by the Court. It is also contended that

statements of majority of the witnesses have been recorded.

5. I have considered the contentions.

6. Considering the contentions put forth by counsel for the

State, I am not inclined to entertain the second bail application.

7. This second bail application is, accordingly, dismissed.

8. Trial Court is directed to expedite the disposal of the case.

9. However, it is noted that while rejecting the first bail

application, it was erroneously mentioned that witnesses have

seen the petitioner murdering the deceased in his car.
