This criminal writ petition is preferred by the convict by post

being aggrieved with the decision of the District Parole Committee,

Udaipur dated 21.12.2020 whereby, he is denied benefit of first

parole of twenty days. The reason for denying the parole to the

petitioner given by the District Parole Committee is that the

petitioner is a person of criminal tendency and if he is released on

parole, he may be dangerous for safety of his family members and

neighbors.

Pursuant to the directions given by this Court on 13.08.2021,

learned Additional Advocate General has furnished the details of

criminal antecedents of the petitioner and from the same, it is

clear that petitioner has been convicted only in the present case

and no other criminal case has ever been lodged against him.

Taking into consideration the overall facts and circumstances

of the case, this criminal writ petition is allowed and it is directed

that the respondents shall release the petitioner- Jagdish S/o

Ambawa on first parole of twenty days on usual conditions.

Copy of this order be sent to the Superintendent of Central

Jail, Udaipur.
