By our judgment and order dated December 24,
2021, MAT No.1307 of 2021 was disposed of. The
operative portion of the said order reads as follows:
"On an overall consideration of the facts and
circumstances of the case, we are of the view that
ends of justice will be served if the State pays
interest @5% per annum on the principal sum for the
period from January 1, 2018, till the date of
payment. Such payment is to be made within a
month from the date of communication of this order.
In the event such payment is not made within the
aforesaid period of one month from the date of
communication of this order by the writ
petitioner/respondent to the concerned Officer, the
applicable interest rate from January 1, 2018 would be 8% per annum till the date of payment."
The State preferred a Special Leave Petition from
the said order being Special Leave to Appeal (C) No.
3570/2022. By an order dated May 6, 2022, the
Hon'ble Supreme Court dismissed the Special Leave
Petition by extending the time for making payment in
terms of our order by a period of two months from May
6, 2022.
In that view of the matter, let this contempt
application be listed once again on July 11, 2022,
when it is expected that the alleged contemnor will file
an affidavit of compliance.
