PER DHIRAJ SINGH THAKUR (CJ) (Oral):

The present Letters Patent Appeal has been preferred against

the judgment and order, dated 25.09.2023, passed in W.P.

No.22004 of 2023.

By virtue of the judgment and order impugned, the learned

single Judge, by following his earlier order dated 09.08.2023 in

W.P. No.17209 of 2023, allowed the petition and quashed the

impugned ECIR/VKSZO/27/2022, dated 31.05.2022, as also the

Provisional Attachment Order No.01/2023, dated 10.05.2023, and

Original Complaint No.1996 of 2023, dated 08.06.2023, pending

before respondents 3 and 4 in the writ petition, as also issued

directions to release all the seized property, material and

documents forthwith.

2. Learned counsel for the appellants, however, states that

this Court has already taken a view in connected matters being Writ

Appeals bearing Nos.967, 641, 1010 and 1011 of 2023, dated

05.01.2024, holding that the writ appeals were not maintainable in

view of the judgment of the Apex Court rendered in Ram Kishan

Fauji vs. State of Haryana and others1.

3. Be that as it may, following the view already expressed by

this Court in the aforementioned writ appeals, we hold that the

present writ appeal is not maintainable and accordingly dismiss the

same. No order as to costs.

Pending miscellaneous applications, if any, shall stand closed.
