                       1) Whether the Judgment impugned is
                          in violation of Order 41 Rule 17 CPC
                          and whether in Second appeal this
                          Court is entitled to decide on merits
                          of the appeal or not?
                       Heard arguments of learned counsel on
                 both sides in part.
                       Registry is directed to delete the name of
                 Sri Narasimha Rao Davuluri as one of the
                 learned counsel for respondents.
