This is an application seeking condonation of 1012 days delay in preferring the writ appeal against the judgment and order dated 30.11.2020 passed in W.P.No.22483 of 2020.

It is stated that the judgment and order was rendered on 30.11.2020. Thereafter, it is stated that a review petition came to be filed on 23.02.2021, which came to be dismissed on 15.06.2023. It is stated that the Letters Patent Appeal was then filed on 09.10.2023.

Considering the ratio of the judgment of the Apex Court in State of Manipur and others vs. All Manipur Regular Post Vacancies S.T.A. and others [(1997)10 Supreme Court Cases 385], which holds that the time spent between the filing of the review petition till its disposal has to be excluded for the purposes of computing the period of limitation, we are of the opinion that the appellant has made out a case for seeking condonation of delay.

Be that as it may, the application is allowed and the delay is condoned.

List on 23.01.2024 for consideration.
