Heard Smt.K.Pallavi, learned counsel for petitioners/appellants through V.C. and Smt.Y.L.Siva Kalpana Reddy, learned counsel for respondent.
This application is filed U/o.41 Rule 5 CPC to stay all further proceedings in E.P.645/2023 in pursuance to judgment and decree dated 27.01.2023 passed in O.S.73/2017 on the file of learned VI Addl.District Court, Nellore, pending disposal of the appeal.
The learned counsel for petitioners/appellants would submit that as per information in C.I.S. pertaining to the Executing Court would

show that the Execution Petition filed by the respondent is posted to today for delivery, and in that view of the matter, stay may be granted.
The learned counsel for respondent would submit that Execution Petition was filed, but, notice only was ordered by the Executing Court, and delivery is not yet ordered.
Considering the above facts and circumstances, it is ordered that if delivery was not effected by 04.01.2024, and Execution Petition is still pending, "there shall be interim stay of execution proceedings in E.P.645/2023 on the file of learned VI Addl.District Court, Nellore, for a period of four (04) weeks", pending disposal of the application.
