I.A.No.2 of 2022 This petition is filed for stay of operation of the decree and judgment in MVOP.No.23 of 2019 dated 18.01.2022 on the file of Motor Accidents Claims Tribunal- cum-III Additional District Judge, Nellore pending disposal of the appeal.

Contd., Learned counsel for the petitioner/ appellant/respondent No.3 submitted that the award is challenged stating that the deceased is an unauthorized passenger travelling in a goods vehicle and, therefore, the insurance company is not liable to pay the compensation.

Since the hearing and disposal of appeal would take considerable time, it is a fit case to grant stay as prayed for on the condition that the petitioner/appellant shall deposit 50% of the amount awarded together with proportionate interest and costs within eight (8) weeks from the date of this order. If the petitioner fails to comply the condition, interim order stands vacated.
