HON'BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA

               WRIT PETITION No. 10209 of 2020

ORDER:

Heard the learned counsel for the petitioner and the

learned Government Pleader for the respondents.

2. The present writ petition is filed to declare the impugned

memo No.ESE02-20021/17/2018-RECTMT-CSE, dated

20.05.2020, issued by the 2nd respondent, wherein issued certain

instructions to all the DEOs in the state to complete the

recruitment process to the post of School Assistant (Telugu) and

Language Pandit (Telugu) in accordance with G.O.Ms.No.67 SE

Department, dated 26.10.2018, as illegal and arbitrary and

consequently set aside the same and to pass such other order in

the circumstances of the case.

3. Learned counsel for the petitioner submits that in view of

interim directions already granted in favour of petitioner directing

the respondent authorities to keep two posts vacant vide order

dated 19.06.2020, in turn, 2nd respondent addressed a letter

dated 15.10.2020, wherein it is specifically stated that two posts

were kept vacant in respect of petitioner, as per the interim

directions of this Hon'ble Court and the remaining process of

selection was completed. Learned counsel for the petitioner

further submits that in view of the posts kept vacant and in view of

the Judgment of this Hon'ble Court in Writ Petition Nos.9118,

9164, 11961, 17367 and 17864 of 2020, dated 25.03.2021, the

main contention of the petitioner should be considered and writ

petition can be allowed.

4. On the other hand, learned Government Pleader would

submit that the issue involved in this petition is squarely covered

by the order of this Court in Writ Petition Nos.9118, 9164, 11961,

17367 and 17864 of 2020, dated 25.03.2021 and the memo

which was impugned in the present writ petition was already set

aside, but in respect of appointment of the petitioner to the

suitable post and suitability should be left to the authorities, in

accordance with law.

5. Having regard to the submissions made by the learned

counsel for the petitioner and the learned Government Pleader,

this Court is of the considered view that this Writ Petition can be

disposed of in terms of the order in Writ Petition Nos.9118, 9164,

11961, 17367 and 17864 of 2020, dated 25.03.2021, by directing

the respondent authorities to take steps for appointment of the

petitioner, if she is eligible in all aspects, in view of the Judgments

rendered by this Hon'ble Court and complete the exercise within

a period of two months from the date of receipt of a copy of this

order. There shall be no order as to costs.

6. Consequently, miscellaneous applications, pending if any,

shall stand closed.

7. The Registry is directed to attach a copy of the order in Writ

Petition Nos.9118, 9164, 11961, 17367 and 17864 of 2020, dated

25.03.2021 to this order.
