ORDER:

This writ petition is filed under Article 226 of the

Constitution of India seeking to issue a Writ of Mandamus

declaring the action of the 2nd respondent in interfering with the

erection of Ground Based Tower in Survey No.221/6 situated at

Thotada Village and Munagapaka Mandal, Visakhapatnam

District, as per permission proceedings dated 23.05.2022 pursuant

to notice dated 30.05.2022, as illegal, arbitrary and contrary to the

provisions of the Andhra Pradesh Panchayat Raj Act, 1994.

During hearing, Sri Ghanta Sridhar, learned counsel for the

petitioner and Sri I.Koti Reddy, learned Standing Counsel for 2nd

respondent-Gram Panchayat submitted that the issue in the

present writ petition is squarely covered by the judgment of the

Division Bench of this Court in W.P. (PIL) No.92 of 2019 dated

21.10.2019.

In view of the submission made by both the learned counsel,

this Writ Petition is disposed of in terms of W.P. (PIL) No.92 of

2019 dated 21.10.2019. There shall be no order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in

this Writ Petition shall stand closed.
