          CIVIL REVISION PETITION No.174 of 2021

ORDER:

The petitioner herein had filed O.S.No.8 of 2016 before the

Junior Civil Judge, Rayadurg for specific performance of an

agreement of sale in relation to the suit schedule property. The

said suit was decreed by way of judgment and decree, dated

05.07.2016. Thereafter, the petitioner has filed E.P.No.11 of 2017

for execution of deed of sale and registration of the said deed of

sale in favour of the petitioner in respect of the E.P.Schedule

property. The docket proceedings of the Executing Court, dated

17.04.2017, shows that the notice had been served on respondents

1, 2, 4 and 5. The docket proceedings of 12.06.2017 shows that

notice has been served on the 3rd respondent also. Thereafter, the

matter has been adjourned from time to time without any

movement in the execution petition proceedings.

2. The petitioner being aggrieved by the non-disposal of the

execution petition over the past four years, despite service of notice

to the respondents, has approached this Court by way of the

present revision petition being aggrieved by the ex-ordinary delay

in the disposal of the execution petition.

3. The suit had been decreed on 05.07.2016 and the execution

petition has been pending since 2017. They does not to be

appeared hurdle in completing the proceedings as the respondents

had also been served with notice in the case and have chosen not

to appear before the Court.

4. In the circumstances, it would be appropriate to dispose of

this revision petition directing the Executing Court to complete the

execution proceedings at the earliest and preferably within four

months from the date of receipt of this order. There shall be no

order as to costs.

Consequently, miscellaneous petitions, if any, pending shall

stand closed.
