Learned counsel for the appellant filed
memo reporting that R-3 died on 20.11.2020 and
his wife also died on 09.02.2021 and both of
them died without leaving any child.
The appellant herein is the second
defendant and respondent nos.1 and 2 who are
minors, being represented by their mother, are the plaintiffs and the third respondent herein is the first defendant.
As can be seen from the judgment in the suit, the first defendant i.e. the third respondent herein, remained ex parte and it is only the second defendant who is the appellant before this Court contested the suit.
In this context, the learned counsel for the appellant requested time to examine as to whether it is required to bring in legal representatives of R-3 on record.
Though notice to R-1 and R-2 was served even before the last date of adjournment, no representation was made on that day or today.
Post on 14.06.2022.
Till then, interim order granted in I.A.No.1 of 2022 is extended against respondent nos.1 and 2.
