Juul Lab, a San Francisco-based e-cigarette manufacturer filed an allegation against 23 vendors for infringing their patents. They filed the allegation with the US International Trade Commission (ITC).

According to the allegation, certain imported components of various vendors infringed several “electronic nicotine delivery system” patents belonging to Juul Lab.

Mainly, the imported components included various e-cigarettes and vaporizers. The plaintiff is popularly known for their use of nicotine salts from leaf-based tobacco.

According to the allegation, these 23 vendors have infringed several Juul Lab's e-cigarettes patents. These are the imported internal components of electronic nicotine system.

They infringed five of the plaintiff's patents (US numbers 10,058,129; 10,104,915; 10,111,470; 10,117,465; and 10,117,466). All of these patents are related to different components of e-cigarettes and vaporizers. They accused the defendants of using the same integral components without seeking prior permission or licence

The plaintiff in their allegation claimed, that these vendors violated section 337 of the Tariff Act of 1930. They further requested ITC to initiate their investigation about the matter.

According to the claim, these activities produced a negative effect on the business of Juul lab. They have suffered huge losses due to infringement of such nature.

Plaintiff further requested ITC to issue a temporary exclusion order to the defendants. Furthermore, they asked them to issue cease and desist letters to the defendants to stop from further infringing their patents.

The US International Trade Commission (ITC) announced in a press release issued on 20th December 2018 that ITC has decided to begin an investigation in context to these e-cigarette vendors after receiving the complaint by manufacturer Juul Labs and ITC shall take necessary actions after completing the investigation.
