Officials in the city of Henderson, Nevada recently filed a Trademark Infringement lawsuit against the city of Naperville, Illinois.

The cause of the lawsuit was the name of a downtown development project in the city of Naperville along Water Street. The new district in development was named ‘Water Street District’. But the city of Henderson owns exclusive, nationwide rights to use the name Water Street District.

The officials in Henderson sent a letter to the officials in Naperville in 2017 after hearing that the city was using the name Water Street District.

The city documents stated, “The letter asserted that the use of that phrase by the city of Naperville and by the Water Street property owner is unauthorized and violates the city of Henderson Redevelopment Agency’s Trademarks rights, protected by registration with the U.S. Patent and Trademark Office in August of 2014.”

Naperville officials recently decided that they would cease to use the phrase ‘Water Street District’ to describe the ongoing project along Water Street. The decision was made when it came to their notice that the city of Henderson has the sole rights to that name and are protected by the U.S. Patent Office.

Naperville’s settlement means that there will be no Trademark rights violation and the city also agreed that it will not attempt to register Water Street District with the U.S. Patent and Trademark Office. It also means that the city can’t use Water Street District in ads, on maps, newsletters or on any other merchandise.
