In a significant legal development, Tractors and Farm Equipment Ltd. (Tafe), a leading tractor manufacturer based in Chennai, has been granted temporary relief by the Madras High Court. The court has prohibited Massey Ferguson Corp., a subsidiary of the US-based Agco Corp., from interfering with Tafe's use of the Massey Ferguson brand and trademarks in India.
Tafe, in a press release on Friday, highlighted that the injunction is a result of its ongoing legal battle to defend its exclusive right to use the Massey Ferguson brand in the Indian market. This relief comes after Agco Corp. terminated its longstanding business arrangement with Tafe, which had allowed the Indian company to sell tractors under the Massey Ferguson brand.
The dispute traces back to April 2024, when Agco abruptly ended a trademark usage agreement that had been in place since 1994. On September 30, Agco formally terminated the arrangement, alleging multiple breaches of agreements by Tafe. As a result, Tafe lost its status as a licensee, distributor, and seller of Massey Ferguson products in India and neighbouring countries.
Tafe, however, argues that it holds exclusive rights to the Massey Ferguson brand in India and asserts that the brand’s trademarks are deeply tied to its identity. In its legal filings, Tafe contended that the termination was hasty and ill-intentioned, putting its international operations at risk. The company also emphasized that it has spent decades and significant financial resources in building the Massey Ferguson brand, particularly in India.
The temporary injunction granted earlier this year by the Chennai Commercial Court permitted Tafe to continue using the brand while the dispute is being adjudicated. Tafe warned that the sudden termination could have severe consequences for Indian farmers who rely on the company’s products, highlighting the potential disruption to agricultural activities in the country.
The legal battle between Tafe and Agco is expected to continue, with both parties preparing to make their cases in court. The outcome will likely have significant ramifications for the Indian tractor market and the future of the Massey Ferguson brand in the country.
