The American subsidiary of the Japanese video gam and Electronics Company filed a lawsuit alleging claims of trademark and copyright infringement back in August 2018.
The company claimed that a website was offering pirated copies of Nintendo ROM’s (Read only memory) without authorization.
The case was filed in the District of Arizona and aimed towards shutting down the websites which promote piracy. The piracy here involves making a digital copy from the video game cartridge and making them available online.
These online copies can be played on various devices via emulators software used to mimic a console, so that console games can be played on any platform). Nintendo’s complaints are against the owners of LoveROMS.com and LoveRetro.co, a married couple by the name of Jacob and Cristian Mathias, which through their websites has made many Nintendo games available for free.
Nintendo alleges that just the top 10 games on the site have been downloaded more than 60 million times and the site receives an average traffic of 17 million per month. Soon after the lawsuit was filed, both of the sites were taken down and LoveROMS took all the Nintendo files out of its directory.
Not weeks ago, around 15th November 2018, Nintendo and the Mathias reached a settlement of $12 million after pleading guilty to the charges by Nintendo.
This lawsuit might have a great impact on the piracy community and may instil fear in the minds of others. Such is the case of EmuParadise which announced that it would no longer offer ROMs, even though they have not been sued by Nintendo.
