MakeMyTrip Limited is the largest Indian online travel company founded in 2000. MakeMyTrip (MMT) provides online travel services including flight tickets, holiday packages, hotel reservations and much more.
Recently, MMT has taken five travel and tourism websites to the court which includes, MakeMyYatra, MakeMyJourney, Make My Happy Journey, Pick My Trip and Superb My Trip.
MMT alleged these companies of using similar sounding names and also some of these companies copied their logo as well.
Court stated in an interim order that, “Till further orders, the defendant, its partner, directors, shareholders or proprietors as the case may be, its assigns in business, franchisees, affiliates, subsidiaries, licensees and agents are restrained from using in manner whatsoever, selling, offering for sale, advertising directly or indirectly dealing in any products or services under the infringing marks, namely PickMyTrip (word per se)."
A similar order was also passed against MakeMyYatra on December 5 by the Delhi court.
Regarding the infringement, a MMT spokesperson said that it is important to take actions and legal proceedings against some businesses to safeguard their legal rights and to make sure no one infringes their brand name or use a similar logo.
As per the petition filed in the Delhi High Court, MMT stated that they have spent Rs. 1,264 Crore out of Rs 2,759 Crore in advertising and marketing which is almost 46% of the total revenue of their brand and they don’t want any other business to confuse their customer and take undue advantage of MMT’s brand name.
The actions taken against other businesses over infringement of trademarks were necessary according to MMT as it can negatively impact the reputation acquired by MMT.
