November 15, 2017:

Central Govt want to allow NRIs to use proxy voting on the lines of defence personnel.

Centre submitted before Supreme Court  that Government intended to introduce a bill during winter session of the Parliament to amend a law to allow the NRIs to vote through postal or e-ballots.

SC Bench had on July 14 asked Centre to decide whether it would amend electoral law to allow the NRIs to vote by postal or e-ballots after Election Commission (EC) had agreed to allow the NRIs to caste their vote.

Following Centre's submission, Apex Court Bench comprising of CJI Dipak Misra and Justice A M Khanwilkar and Justice D Y Chandrachud adjourned the hearing on the issue.

EC had stated that the move to allow the NRIs to use proxy voting on lines of the defence personnel would necessitate changes in Representation of People Act or in rules made under the Act.

SC Bench had sought a response from EC on the petition demanding that every EVM to be used in Gujarat Assembly Polls be fitted with the Voter Verifiable Paper Audit Trail (VVPAT).

Petitioner Manubhai Chavada has opposed Rule 56(D) (2) of Conduct of Elections Rules conferring the discretionary power on returning officer to refuse counting of the VVPAT.
