CIC directs CBSE: Allow inspection of Smriti Irani’s 10th and 12th Board records

CIC trashes the CBSE plea that they constitute personal information and can’t be shared.

Central Information Commission has directed CBSE (Central Board of Secondary Examination) to allow inspection of the standard 10th and 12th school records of Union Minister Smriti Irani, rejecting CBSE’s contention that it constituted personal information.

Office of Union Minister of Textiles and Holy Child Auxilium School, Delhi, from where she has claimed to have passed out, have been directed by Commission to provide the roll number or reference number of Smriti Zubin Irani to CBSE, Ajmer, which possesses records for the years 1991 and 1993 “to facilitate search from the huge records which are yet to be digitized.”

The Commission rejected the argument that information was “personal information” and thus could not be disclosed.

Information Commissioner rejected the contention of the CBSE that the information is yet to be digitised and they will have to divert resources to dig out the information from the voluminous records.Information Minister added that,“Excuse of practical difficulty in searching from the huge volume of the records for year 1991 and 1993 to furnish information sought…is not valid.

PIO cannot make the RTI applicant to wait until digitization of the 1991 records. They have to adhere to 30 days timeline as per the RTI Act to provide information sought,” he added.
