  1. Short title, extent and Commencement.- (1) This order may be called the Uttar Pradesh Rice and Paddy (Levy and Regulation of Trade) Order, 1985.

(2) It extends to the whole of Uttar Pradesh.

(3) It shall come into force at once.

  1. Definitions.- In this order unless the context otherwise requires:

[(a) "Basmati rice" means the scented variety of rice as classified in Schedule V.]

[(a-1)] "Border area" means-

(i) the area of sixteen kilometers all along the border of the State adjoining the territory of China;

(ii) the area of fifteen kilometers all along the border of the State adjoining the territory of Nepal.

(b) "Controller" means the Regional Food Controller and includes Deputy Regional Food Controller, Regional Marketing Officer, Deputy Regional Marketing Officer or Assistant Regional Food Controller.

(c) "Custom Milling" means milling of paddy, not belonging to the miller, into rice in his rice mill on payment of milling charges in cash or in kind.

(d) "Enforcement Officer" means the Commissioner, Food and Civil Supplies, Uttar Pradesh, Additional Commissioner, Food and Civil Supplies, Uttar Pradesh, Deputy Commissioner, Food and Civil Supplies, Uttar Pradesh, Assistant Commissioner, Food and Civil Supplies, Uttar Pradesh, the Chief Marketing Officer, Food and Civil Supplies, Uttar Pradesh, the District Magistrate, Executive Magistrate, Tahsildar, Naib-Tahsildar, the Regional Food Controller, Deputy Regional Food Controller, Regional Marketing Officer, Deputy Regional Marketing Officer, Assistant Regional Food Controller, Senior Marketing Inspector, Marketing Inspector, Assistant Marketing Inspector, District Supply Officer, Town Rationing Officer, Deputy Town Rationing Officer, Area Rationing Officer, Senior Supply Inspector, [Deputy Director (Food and Civil Supplies), Revenue and Special Intelligence Directorate, Uttar Pradesh, Lucknow], Supply Inspector, a Police Officer not below the rank of Sub-Inspector within the limits of their respective jurisdiction and a Police Officer not below the rank of Sub-Inspector attached to the Commissioner, Food and Civil Supplies;

(e) "Landless agricultural laborers" means a person whose main source of livelihood is agricultural labour or cultivation and who, immediately before the commencement of this Order, neither holds no land or holds land not exceeding 0.40468564 hectare (one acre) in Uttar Pradesh as a Bhumidharisirdariasami or Government lessee;

(f) "Licensed dealer" means a person holding licence in Form 'B', 'D' or 'E' under the [Uttar Pradesh Scheduled Commodities Dealers (Licensing and Restriction on Hoarding) Order, 1989];

(g) "Licensed miller" means the owner or other person incharge of rice mill, holding a valid licence under the Rice Milling Industry (Regulation) Act, 1958 (Act No. 21 of 1958) and includes a person or authority which has the ultimate control over the affairs of such mill and when the said affairs are entrusted to a Managing Director or Managing Agent, such Manager, Managing Director or Managing Agent;

(h) "Notified Price" in relation to any variety of paddy or rice means price as notified by the State Government from time to time with the prior concurrence of the Central Government;

(i) "Paddy" means rice in husk;

(j) "Permit" means a permit issued by the Controller or an Officer authorised by him to a licensed miller to undertake custom milling;

(k) "Release Certificate" means a certificate granted in the form given in Schedule 1 by a Marketing Inspector to a licensed dealer or licensed miller in token of his having sold the required quantities of rice/paddy to the State Government;

(l) "Rice" means raw or parboiled rice;

(m) "Rice Mill" means the plant and machinery with which and the premises, including the precincts thereof, in which or in any part of which rice milling operation is carried on and includes a rice huller attached to or maintained with any flour, oil, dal or other mill or pumping set;

(n) "Schedule" means a schedule to this order;

(o) "Specifications" means the specifications prescribed for" paddy and rice and notified by the State Government from time to time;

(p) "Urban area" means area included in any Town Area, Notified Area, Cantonment Board, Municipal Board or a Nagar Mahapalika.

[(q) "Exporter of cent per cent Basmati rice" means a person who produces Basmati rice and exports cent per cent production thereof and who is recognised as exporter by the Controller or his nominee and shall include a person who exports rice through such recognised exporter of cent per cent Basmati rice.]

  1. Levy on rice produced or in stock.- (1) Every licensed miller shall sell and deliver to the State Government at notified price sixty per cent of each variety of rice conforming to specifications-

(a) held in stock and owned by him on the date of commencement of this Order;

(b) milled by him every day out of stocks of paddy owned by him; and

(c) purchased by him or coming into his custody or possession for sale or disposal through him on commission basis or in any other manner every day beginning with the date of commencement of this Order and until such time as the State Government otherwise directs;

Provided that in case of rice mills of huller type with not more than one huller, the Controller may agree to accept a fixed quantity of rice of such variety or varieties as may be specified in lieu of the quantity due by way of levy as aforesaid for such period as may be agreed upon. The agreement shall be in the form set out in Schedule II:

Provided further that nothing contained in this sub-clause shall apply to a licensed miller having rice mill or huller type with not more than one huller operating in any area other than urban area:

[Provided also that with regard to the levy rice required to be sold to the State Government on or after October 1, 1994 by the millers in accordance with the provisions of this sub-clause, the millers shall use only new [double-line machine stitched gunny bags for 95 Kg. or 50 Kg. packing of such specifications as may be stipulated in this behalf by the Central Government from time to time] for the delivery of levy rice:

Provided also that the licensed miller shall be paid compensation for double-line machine stitching and for the price of the new [gunny bags] at such rates as may be declared by the State Government from time to time.]

(2) Every licensed dealer shall sell and deliver to the State Government a notified price sixty per cent of each variety of rice conforming to specifications-

(a) held in stock and owned by him on the date of commencement of this Order;

(b) milled by him every day out of his stocks of paddy; and

(c) purchased by him or coming into his custody or possession for sale or disposal through him on commission basis or in any other manner every day beginning with the date of commencement of this Order and until such time as the State Government otherwise directs;

Provided that no levy shall be imposed under this sub-clause on the Food Corporation of India:

[Provided further that no levy on Basmati rice shall be imposed under this clause:]

[Provided also that with regard to the levy rice required to be sold to the State Government on or after October 1, 1994 by the dealers in accordance with the provisions of this sub-clause, the millers shall use only new [double-line machine stitched gunny bags for 95 Kg. or 50 Kg. packing of such specifications as may be stipulated in this behalf by the Central Government from time to time] for the delivery of levy rice:

Provided also that the licensed dealer shall be paid compensation for double-line machine stitching and for the price of the new [gunny bags] at such rates as may be declared by the State Government from time to time.]

  1. Levy rice to conform to specifications.- The rice required to be sold to the State Government under Clause 3 shall conform to the specifications of rice of fair average quality notified by the State Government for that respective variety of rice and shall not contain refractions beyond rejection limit shown in the Government notification and in case any stock of rice offered for sale does not conform to such specifications, it shall be reconditioned or rectified or otherwise brought in conformity with specifications by the licensed miller or the dealer as the case may be before being so offered.
  2. Restriction on disposal of paddy and rice without selling the prescribed percentage to Government.- (1) No licensed miller or licensed dealer shall sell or otherwise dispose of or remove to any place other than his usual place of business or storage in a particular locality his stocks of rice or paddy except in accordance with a release certificate issued by the Centre Incharge/Senior Marketing Inspector/Marketing Inspector as a token of having sold the prescribed percentage of paddy/rice in levy under Clause 3 to the State Government.

(2) Save as otherwise provided in sub-clause (1) no licensed miller or licensed dealer shall transport rice for sale from the premises of the rice mill or the godown declared in the licence except in accordance with the release certificate referred to in sub-clause (1):

Provided that if part of any lot of rice in respect of which release certificate as aforesaid has been obtained is moved by road, the driver or person incharge of the vehicle carrying such rice shall carry a certificate from the Senior Marketing Inspector/Marketing Inspector having jurisdiction at the place of despatch indicating that rice moved is a part of released stock. The certificate shall also indicate the name, the licence number and address of the dealer/miller in whose favour the particular lot of rice was released and also the date and number or release certificate as well as grades and total quantity of rice released under that release certificate.

Explanation. - No licensed miller who is exempt from levy under second proviso to Clause 3 (1) (c) shall transport from his premises of the rice mill or the godown declared in the licence rice/paddy for sale except in accordance with a transport certificate issued by the Controller or his nominee in the form set out in Schedule III.

  1. Purchase or acceptance of rice by the Controller or his nominee.- The Controller or his nominee-

(a) shall purchase rice from any person including a licensed miller having a rice mill of huller type with not more than one huller operating in area other than urban area also at the notified price if it conforms to the specifications notified;

(b) may in accordance with the directions of the State Government accept for rice due to be sold to the State Government under Clause 3:

(i) parboiled rice of same variety in lieu of raw rice or vice versa;

(ii) rice even in excess of levy due if voluntarily offered.

(c) The Controller or his nominee shall, subject to such general or special instructions as may be issued from time to time by the State Government for taking delivery of the quantity of rice sold under clause 3 on behalf of the licensed miller or the licensed dealer shall give a receipt to him specifying the quantity and variety of rice delivered by him and the date of taking delivery thereof.

  1. Any person not to recover excess price for rice sold in levy.- Any person on whose behalf the licensed dealer holds any stock of rice/paddy the whole or part of which such dealer is required to sell to the State Government shall, notwithstanding any contract or instrument of the contrary, not be entitled to recover from the dealer on account of the value of the stock as sold, anything more than the price received by the licensed dealer under the said sub-clause.
  2. Mode and manner of delivery of rice.- Every person from whom levy is due under this order shall deliver to the Controller or his nominee the stocks of rice-paddy required to be sold in such lots and in such manner, at such place and at such times as the Controller or his nominee may direct.
  3. Recovery of rice from paddy.- The percentage of rice recovered from corresponding variety of paddy shall be deemed to be as follows, unless proved to the contrary and the levy due under clause 3 shall be calculated accordingly:
Common variety .... .... 68
Fine and super fine variety .... .... 66.5
Scented variety .... .... 66

Provided that the State Government may, in public interest, reduce the percentage of recovery in respect of any area or in relation to any variety or grade of paddy:

Provided further that if the actual recovery in a mill is higher than the deemed recovery percentage levy shall be taken on the basis of deemed recovery percentage and not on the actual recovery:

Provide.d also that the Controller on being satisfied that the percentage of recovery in any case is less than that specified in this clause may accept such reduced percentage of levy as he, for reasons to be recorded in writing, thinks fit.

  2. Permit for custom milling.- No licensed rice miller shall undertake custom milling of paddy except under and in accordance with a permit in the form set out in Schedule IV issued by the Controller or an officer authorised by him in this behalf.
  3. Levy on Paddy.- (1) Every licensed miller or licensed dealer shall sell to the State Government at the notified price sixty per cent of any paddy in stock on the commencement of this order or received by him thereafter and remaining unconverted into rice, khell, laiya or choora within three months or such extended time as the Controller may, in special circumstances allow:

Provided that in case time is extended beyond three months, the Controller shall make a report of the order extending time to the State Government, who may vary, amend or rescind such order:

Provided further that no levy shall be imposed on any stock of paddy, purchased or otherwise acquired in respect of which levy in accordance with this sub-clause has been imposed and paddy delivered to the State Government:

Provided further that no paddy shall remain unmilled with the millers at the end of the marketing season in which the paddy has been purchased.

(2) The licensed miller or licensed dealer who has delivered levy paddy under sub-clause (i) shall obtain a release certificate and the provisions of clause 5 shall mutatis mutandis apply to movement of such paddy.

(3) The conditions prescribed in regard to specifications, payment of notified price and delivery of levy rice shall mutatis mutandis apply to the delivery of paddy under sub-clause (2).

  2. Restriction on movement of rice and paddy into and within the border area.- No person shall move, attempt to move or abet the movement of paddy/rice-

(a) to any place in the border area from any place outside that area; or

(b) from any place in the border area to any other place in that area; except under and in accordance with a permit issued in this behalf by the State Government or the Regional Food Controller or the District Magistrate of the border area concerned:

Provided that nothing contained herein shall apply to such movement:

(i) on Government account or by or on behalf of the Food Corporation of India; or

(ii) under and in accordance with the Military Credit Notes; Or

(iii) within the same town or village in the border area.

  1. The driver or incharge of vehicle carrying paddy or rice through an interlaying territory of Uttar Pradesh shall produce his documents before the Marketing Inspector/Senior Marketing Inspector of the nearest check post of Uttar Pradesh who shall, after necessary verification to his satisfaction, make an endorsement to the following effect which shall entitle the vehicle to cross the exit barrier of the State.

Certified that vehicle bearing no................. is carrying .............. (qtls.) of common/fine/supreme/scented variety of paddy/rice from ............... to ............................................ through Uttar Pradesh and has entered the State barrier.................................at................. (hrs) of ................ (date) ................. This certificate shall remain valid up to.......................

Signature of the Marketing Inspector/Senior Marketing Inspector.

  1. Prices and specification.- For the paddy or rice delivered as levy, payment shall be made at the notified price in accordance with the specifications to be notified by the State Government from time to time.
  2. (1) The notified price referred to is for the fair average quality of rice or paddy of that variety conforming to the specifications notified under clause 16 and shall be subject, in relation to rice or paddy below that quality, to deductions specified in the specifications.

(2) If rice or paddy offered for sale contains admixture of lower varieties exceeding rejection limit mentioned in the specifications for that particular variety or rice or paddy, the Controller or his nominee may direct the concerned licensed dealer/miller to bring such rice or paddy in conformity with the specifications by removing such admixtures;

Provided that if rice or paddy offered for sale contains admixture of any variety of rice or paddy specified in Schedule V beyond rejection limit mentioned in the specifications for that particular variety of rice or paddy, the Controller or his nominee may for the purpose of this Order treat such rice/paddy belonging to that lower variety the admixture of which is highest and price for that lower variety shall be payable for such rice/paddy.

(3) (i) Four samples of rice or paddy delivered in levy shall be drawn, sealed and signed by the licensed dealer/miller or his representative and the Controller or his representative. One sample shall be handed over to the licensed dealer/miller or his representative and two samples shall be forwarded to the Regional Check Laboratory. The Controller or his representative shall make analysis of the remaining sample in presence of the licensed dealer/rrtiller or his representative and make payment to the notified price accordingly.

(ii) If the licensed dealer/miller is not satisfied with the result of analysis done he shall within three days file on objection in writing to the person who made the analysis for its re-analysis;

Provided, however, that no objection shall lie in respect of moisture content.

(iii) The objection referred to in sub-clause (ii) above shall be forwarded to the Incharge, Regional Check Laboratory within three days. The Incharge, Regional Check Laboratory shall fix a date for analysis not later than fifteen days of the receipt of such objection and intimate the concerned licensed dealer/miller to be present at the time of analysis.

On the fixed date, analysis of the sample shall be done at the Regional Check Laboratory by the Regional Marketing Officer.

(iv) If the licensed dealer/miller is not satisfied with the result of analysis done at the Regional Check Laboratory, he may within three days of such analysis, represent to the Regional Food Controller for analysis at the Central Check Laboratory. The Regional Food Controller shall forward such representation to the Chief Marketing Officer. The Chief Marketing Officer shall fix a date for analysis of the sample not later than fifteen days of receipt of representation from the Regional Food Controller and direct concerned licensed dealer/miller to be present at the time of analysis along with the sealed sample given to him. On the fixed date analysis of such sample in possession of licensed dealer/miller shall be done at the Central Check Laboratory by the Chief Marketing Officer whose findings shall be final.

(v) Necessary adjustment in price shall be made according to the results of final analysis at the Regional/Central Check Laboratory as the case may be.

  1. Power to direct a rice mill to convert paddy into rice.- The State Government may direct any licensed rice mill to convert any stocks of paddy into rice held by the State Government or its agencies on such terms and conditions as may be notified by the State Government from time to time:

Provided that the quantity of paddy to be given to a rice mill by the State Government or its agencies during one kharif marketing season beginning from 1st October shall not exceed forty per cent the annual licensed capacity to be calculated on an average of 300 working days.

Explanation. - For the purpose of this clause the licensed milling capacity of any licensed rice mill shall be the same as mentioned in the licence issued under the Rice Milling Industry (Regulation) Act, 1958 and the rules made thereunder.

  2. Powers of entry, search and seizure.- (1) The Enforcement Officer, may with a view to securing compliance with this Order or for satisfying himself that this order has been complied with:

(a) inspect or cause to be inspected any book or document or accounts as well as any stock of rice or paddy belonging to or under the control of miller or a dealer;

(b) require any person to give any information in his possession with respect to any undertaking or business for producing or manufacture of rice for purchase, sale or storage for sale of rice or paddy;

(c) stop and with such aid or assistance as may be necessary any person or vehicle or animal used or suspected of being used for delivery of rice or paddy from the mill or other premises of the miller or dealer where, he has reason to believe, rice or paddy is stored;

(d) enter and search, with such aid or assistance as may be necessary such mill or other premises;

(e) seize and remove with such aid or assistance as may be necessary-

(i) any stock of rice or paddy in respect of which or part of which he has reason to believe the contravention of any of the provisions of this order has been or is being or is about to be committed;

(ii) any package, covering or receptacle in which such stock of rice or paddy is found; and

(iii) any animal, vehicle, vessel or other conveyance used in carrying such stock of rice or paddy if he has reason to believe that such animal, vehicle, vessel or other conveyance is liable to be forfeited under the provisions of the Essential Commodities Act, 1955 and thereafter, without unreasonable delay, make a report to the Controller under the provisions of Section 6-A of the said Act.

(f) Seize and remove any books of accounts or documents which in his opinion, shall be useful for, or relevant to any proceeding in respect of any contravention of this order and allow the person from whose custody such books of accounts or documents are seized to make copies thereof to take extracts therefrom in his presence.

(2) The provisions of Section 100 of the Code of Criminal Procedure, 1973 (Act No. 2 of 1974), relating to search and seizure shall, so far as may be, apply to search and seizure under this clause.

  1. Maintenance of accounts.- Every licensed dealer and licensed miller shall maintain such records and submit such periodical return as the controller or his nominee may direct from time to time.
  2. Appeal.- (1) Any miller or dealer or other person aggrieved by the order of the Controller or his nominee fixing the quantity of levy, may within seven days from the date of service of such order, appeal to the Divisional Commissioner exercising jurisdiction in the area in which the mills of the miller, or the business premises of the dealer is situate.

(2) The Divisional Commissioner shall fix the date, time and place for hearing the appeal thus preferred to him and may from time to time adjourn the hearing.

(3) The Divisional Commissioner may in appeal confirm or set aside the order appealed against or reduce or enhance the quantity of rice to be sold under the said order.

(4) The Divisional Commissioner shall communicate in writing the order passed in appeal to the appellant and also the purchase officer concerned. Every Order of the Divisional Commissioner on such appeal shall be final.

  1. Duty to comply with order.- Every licensed miller or licensed dealer to whom an order or direction is given under any power conferred by or under this Order shall comply with such order or direction.
  2. Power to exempt.- (1) With the prior concurrence of the Central Government, the State Government may-

(a) in the public interest increase or reduce the percentage of levy;

(b) in the public interest exempt any area from levy or reduce per cent;

(c) in the public interest reduce the percentage of levy from any type of rice mill in any area:

(d) exempt wholly or partly from levy variety of paddy and rice.

(2) The State Government may, for reasons to be recorded in writing, exempt any lot of paddy or rice from levy wholly or partly if the stock in whole or part is unfit for storage or unfit for sale from fair price shops.

(3) The State Government may postpone the recovery of levy due to be sold to the Government under this Order up to a period of six months on such terms and conditions as may be laid down, if it is satisfied that the paddy or rice due as levy cannot be brought within the notified specifications.

(4) Subject to such instructions as may be issued by the State Government the Controller may permit a person from whom levy of rice or paddy is due to sell to the State Government a variety of rice or paddy other than the variety in respect of which levy is due.

  1. Power to remove difficulties.- The State Government may by general or special order make supplementary provisions in respect of matters for which no provision exist or insufficient provision exists into his order, or may make such other provisions as it thinks fit for the purposes of removing any difficulty.
  2. Rescission.- The Uttar Pradesh Rice and Paddy (Levy and Regulation of Trade) Order, 1981 is hereby rescinded and the provisions of Section 6 and Section 24 of the U.P. General Clauses Act, 1904 (U.P. Act No. 1 of 1904), shall apply in relation to its rescission as they apply in relation to the repeal of an enactment by an Uttar Pradesh Act:

Senior Marketing Inspector.

Note- In case of any defect before reaching the destination the driver of the truck may present an application before the nearest centre incharge and get the validity of the release certificate extended or get both the copies of the release certificate amended for getting the stocks to be loaded in another truck.

The concerned licensee may also dispose of this stock with the permission of the local Senior Marketing Inspector/Marketing Inspector provided that he will intimate also to the Senior Marketing Inspector/Marketing Inspector issuing the release certificate.

Shri/Messrs.............................. (Rice Mill) Licence No..................is hereby permitted to undertake custom milling of paddy on private account subject to the following conditions:

(1) He shall maintain separately a true and correct account of paddy received for custom milling, indicating the name and complete address of the person(s) from whom such paddy is received, the Foodgrains Dealer Licence No. (if the customer is a dealer and the quantity of paddy milled and rice manufactured therefrom.

(2) He shall furnish an abstract of account mentioned in condition (1) above to the Controller/Authorised Officer every month.

(3) This permission is liable for cancellation in the event of violation of any provision of the Uttar Pradesh Rice and Paddy (Levy and Regulation of Trade) Order, 1985 and/or [Uttar Pradesh Scheduled Commodities Dealers (Licensing and Restriction on Hoarding) Order, 1989].
