S.O. 59. - Whereas, a draft of the Rajasthan Insecticides (Appeal) Rules was published as required by sub-section (1) of section 37 of the Insecticides Act, 1968 (Central Act 46 of 1968) at pages 5 to 7 of part III B of the Rajasthan Rajpatra dated the 24th May, 1973, under the notification of the Government of Rajasthan, Agriculture, (Gr. II-A) Department No. F. 15 (37) Agr./Gr. 11/72, dated the 18th April, 1973, inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of thirty days from the date on which the copies of the Official Gazette containing the said notification were made available to the public:

And Whereas, the said Gazette was made available to the public on the 24th May, 1973;

And Whereas no objections and suggestions have been received from the public on the said draft rules;

Now Therefore in exercise of the powers conferred by section 37 of the said Act, the State Government after consultation with the Central Insecticides Board hereby makes the following rules, namely:-

1. Short title and commencement.- (1) These rules may be called the Rajasthan Insecticides (Appeal) Rules, 1980.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definition.- In these rules, unless the context otherwise requires 'Act' means the Insecticides Act, 1968 (Central Act 46 of 1968).
3. Appeal.- (1) Any person aggrieved by a decision of the Licensing Officer under section 13 excepting under the proviso to sub-section (1) thereof, or section 14 of the Act may within a period of thirty days from the date on which the decision is communicated to him, appeal to the Director of Agriculture.

(2) The appeal shall be in writing and shall set out concisely and under distinct heads the grounds on which the appeal is preferred.

(3) Every appeal shall be accompanied by a Treasury Challan evidencing the payment of Rs. 10/- and a copy of the decision appealed against to be obtained from Licensing Officer on payment of necessary fee.

(4) The fee payable for preferring an appeal shall be deposited under the head "XXV-Agriculture (Ka) Agri-Receipts-4-other Miscellaneous Receipts."

(5) Every such appeal shall be presented either in person or through an agent duly authorised in writing in this behalf by the appellant or may be sent by registered post.

4. Procedure to be followed by the Appellate Authority.- In deciding appeals under the Act, the Appellate Authority shall follow the same procedure which a court follows in deciding appeals from decrees or orders of an original Court under the Code of Civil Procedure, 1908 (Central Act 5 of 1908).

[Notification No. F 4(4) Agri./Gr. 2/A/79, dated 6th April 1987, pages 10-11].- In exercise of the powers conferred under sub-section (1) of section 20 of the Insecticides Act, 1968 (Central Act 46 of 1968), the Government of Rajasthan hereby also appoints the following Officers of Agriculture Department as Insecticide Inspectors in respect of the areas specified against them:-

Amendment in Notification Dated 6-8-1985:-

1. Existing Serial Number 4 and entries against it shall be deleted.
2. In existing Serial Number 7, for the expression "District Agriculture Officer, Ajmer", the expression "Assistant Director of Agriculture, Ajmer" shall be substituted.
3. Existing Serial Number 8 and entries against it shall be deleted.
4. In existing Serial Number 12, for the expression "District Agriculture Officer, Jaipur", the expression "Assistant Director of Agriculture, Jaipur" shall be substituted.
5. Existing Serial Number 13 and entries against it shall be deleted.
6. In the existing Serial Number 13 for the expression "District Agriculture Officer, Dausa", the expression "Assistant, Director of Agriculture, Dausa" shall be substituted.
7. Existing Serial Number 18 and entries against it shall be deleted.

11. Existing Serial Number 26 and entries against it shall be deleted.
12. In the existing Serial Number 32 for the expression "District Agriculture Officer, Alwar" the expression "Assistant Director of Agriculture, Alwar" shall be substituted.
13. in the existing Serial Number 39 for the expression "District Agriculture Officer, Sawai Madhopur", the expression "Assistant Director of Agriculture, Sawai Madhopur" shall be substituted.
14. Existing Serial Number 40 and entries against it shall be deleted.

16. In the existing Serial Number 47 for the expression "District Agriculture Officer, Sriganganagar", the expression "Assistant Director of Agriculture, Sriganganagar" shall be substituted.
17. In the existing Serial Number 51 for the expression "District Agriculture Officer, Hanumangarh", the expression "Assistant Director of Agriculture, Hanumangarh" shall be substituted.

48. In the existing Serial Number 138 for the expression "District Agriculture Officer, Tonk", the expression "Assistant Director of Agriculture, Tonk" shall be substituted.
49. In the existing Serial Number 142 for the expression "District Agriculture Officer, Jhalawar", the expression "Assistant Director of Agriculture, Jhalawar" shall be substituted.
50. Existing Serial Number 143 and entries against it shall be deleted.
51. Existing Serial Number 150 and entries against it shall be deleted.

[Notification No. F. 4 (4) Agri./Gr. 2-A/79-Part, dated 30-11-1991, published in Rajasthan Rajpatra, Part IV(Ga), dated 12-12-1991, pages 125-135].- S.O.133. - In exercise of the powers conferred under sub-section (1) of Section 20 of the Insecticides Act, 1968 (Central Act 46 of 1968), and in supersession of this Department Notification No. F. 4 (4) Agri./Gr. 2-A/79, dated 6-8-1985 and Notification of even number dated 30-5-87, 30-4-87, 10-4-89, 20- 7-89, 20-2-90, 16-6-90 and Notification No. F. 2 (15) Agri./Gr. 2Seed/78, dated 26-5-1999, the Government of Rajasthan hereby appoints the following officers of Agriculture Department as Insecticide Inspectors in the areas shown against their respective jurisdiction:-
