               SECOND APPEAL NO.340 OF 2024

JUDGMENT:

On 28.04.2025, when the matter was taken up for hearing, there was no representation on behalf of the appellants and the matter was directed to be listed on 17.06.2025 under the caption for 'dismissal'. On 17.06.2025, learned counsel for appellants sought time even though the matter was listed under the same caption. To give one more chance, matter was directed to be listed on 19.06.2025 finally under the same caption.

2. Today also, when the matter is taken up for hearing, learned Junior Counsel appearing for the learned Counsel on record represented that the learned counsel for appellants on record was held up in another Court and sought time. It appears that appellants are not interested in prosecuting the appeal. Accordingly, Appeal is dismissed for non-prosecution. There shall be no order as to costs.

Pending miscellaneous petitions if any shall stand closed.
