WRIT PETITION No.15978 of 2025
ORDER:
Heard learned counsel for the petitioner and Learned Assistant Government Pleader for Finance and Planning appearing for respondent No.1; learned Assistant Government Pleader for Irrigation appearing for respondent Nos.2, 6 and 7, and learned Assistant Government Pleader for Revenue (Land acquisition) appearing for respondent Nos.3 to 5. With the consent of the parties, the writ petition is being taken up for disposal at the admission stage itself.
2. This writ petition is filed seeking following prayer:
"to declare the action of the respondent authorities in not depositing the compensation as per the judgment and decree in L.A.O.P.No.92 of 2021 dated 15.05.2024 on the file of Hon'ble Land Acquisition, Rehabilitation and Resettlement Authority for the State of Telangana to the credit of E.P.No.29 of 2024 as illegal, arbitrary and consequently direct the respondent authorities to deposit the decreetal amount in L.A.O.P.No.92 of 2021 dated 15.05.2024 on the file of Hon'ble Land Acquisition, Rehabilitation and Resettlement Authority for the State of Telangana to the credit of E.P.No.29 of 2024."
3. Today when the matter has been taken up for hearing, learned counsel for the petitioner submits that in similar circumstance this Court in W.P.No.12837 of 2023 dated 28.04.2023, passed the following order:- 2
"5.Having regard to the same, the Writ petition is disposed of and respondent No.5 is directed to deposit the decretal amount in terms of the order and decree, dated 30.03.2011, passed in O.P.No.65 of 2009 by the Senior Civil Judge, Gadwal, to the credit of E.P.No.5 of 2023 in O.P.No.65 of 2009 on the file of Senior Civil Judge, Gadwal, as expeditiously as possible, at any rate within a period of four (4) months from the date of receipt of a copy of this order. There shall be no order as to costs."
4. Learned counsel for the petitioner further pray this Court to pass similar orders as passed in W.P.No.12837 of 2023 dated 28.04.2023.
5. Learned counsel appearing for respondents did not dispute the same.
6. Recording the submission made by learned counsel appearing on either side and in terms of order passed by this Court in W.P.No.12837 of 2023 dated 28.04.2023, this writ petition is disposed of directing the respondent authorities to deposit the decreetal amount in terms of the order and decree, passed L.A.O.P.No.92 of 2021 dated 15.05.2024 on the file of Hon'ble Land Acquisition, Rehabilitation and Resettlement Authority for the State of Telangana to the credit of E.P.No.29 of 2024, as expeditiously as possible, at any rate within a period of four (4) months from the date of receipt of a copy of this order. 3
7. Accordingly, this writ petition is disposed of. Miscellaneous applications, if any pending, shall stand closed. No order as to costs.
