          CIVIL MISCELLANEOUS APPEAL No.681 of 2013

JUDGMENT:

This Civil Miscellaneous Appeal is filed aggrieved by the order dated 03.06.2013 passed in I.A.No.322 of 2013 in O.S.No.134 of 2013 on the file of the Principal District Judge, Ranga Reddy District at L.B.Nagar.

2. Heard Ms. B.Shruthi, learned counsel representing Mr. Narinder Pal Singh, learned counsel for appellants and Mr. M.Praveen Kumar, learned counsel for respondent.

3. O.S.No.134 of 2013 is filed by Punjabi Welfare Trust represented by its Secretary. Suit is filed seeking a direction to the appellants herein (defendants in the suit) to hand over the suit schedule property, Swarg Dham along with accounts to the plaintiff Trust. Pending disposal of the suit, I.A.No.322 of 2013 is filed under Order XXXIX Rule 1 & 2 r/w Section 151 of CPC, seeking injunction restraining the appellants herein (defendants) from causing any interference with the day to day 2 activities and peaceful possession of the Punjabi Welfare Trust situated opposite Gurudwara, Ramnagar Colony, Alwal, Ranga Reddy District. The Court of Principle District Judge, Ranga Reddy, allowed I.A.No.322 of 2013 in O.S.No.134 of 2013 restraining the appellants in C.M.A. (i.e., defendants in the suit) from interfering with the day to day activities of the plaintiff's Trust and its properties except Swarg Dham, to be managed by 1st defendant i.e., Rajwant Singh Gulati and the plaintiff shall not interfere.

Learned counsel appearing on behalf of appellants (defendants) stated across the Bar that both the appellants in C.M.A. i.e., Rajwant Singh Gulati S/o Late Gurbachan Singh Gulati and S.P.Bandari S/o Late Ram Kishan Bhandari, are no more. It is further stated that there are no legal heirs to both the appellants. It is also submitted that the matter has become infructuous.

5. When queried, what is the stage of suit, it is stated that there is no information as the appellants are no more. 3

6. Be that as it may, if the suit is not disposed by the Concerned Court i.e., the Principle District Judge, Ranga Reddy District, the Court shall take appropriate steps and dispose of the suit as expeditiously as possible.

7. Interim order passed on 03.06.2013 in the suit bearing O.S.No.134 of 2013 shall continue till the final disposal of the suit.

8. For reasons aforesaid, Civil Miscellaneous Appeal is disposed of. No order as to costs.

Miscellaneous applications pending, if any, shall stand closed.
