               CRIMINAL PETITION No.12285 OF 2024
JUDGMENT:

1. This Criminal Petition is filed questioning the order dated 13.06.2024 in Criminal Revision Petition No.10 of 2024 on the file of the Metropolitan Sessions Judge, Hyderabad.

2. The petitioner is accused No.41 in Crime No.201 of 2022. During the course of investigation, Gun No.871 (12 bore-DBBL) and the original licence book were seized from this petitioner by the Marredpally Police Station.

3. Seeking return of the licence and the gun, petition was filed before the X Additional Chief Metropolitan Magistrate, Secunderabad. Learned Magistrate, by order dated 24.12.2022 refused to return the property on the ground that the gun was required to be sent for FSL.

4. The petitioner, then approached the Metropolitan Sessions Judge by filing Criminal Revision Petition No.10 of 2024. Learned Sessions Judge dismissed the Criminal Petition on 13.06.2024.

5. This Court had asked the learned Assistant Public Prosecutor to get instructions regarding the genuineness of the licence and also about the weapon.

6. Learned Assistant Public Prosecutor submits that the case is still under investigation and the licence of the petitioner is genuine.

7. In view of the information given by the learned Assistant Public Prosecutor, this Court deems it appropriate to allow the Criminal Petition directing the Court below to return the gun and licence of the petitioner by imposing conditions, within a period of four weeks from the date of receipt of a copy of this order.

Consequently, miscellaneous applications, if any, shall stand dismissed.
