HON'BLE MR. JUSTICE SUDESH BANSAL Order 02/05/2022 Counsel for appellants-defendants submits that the trial Court dismissed the suit for declaration and permanent injunction filed by respondent-plaintiff, however, in first appeal, the suit has been decreed vide judgment dated 24.04.2015. Counsel for appellants submits that in fact the plot in question measuring 45X30 feet was allotted by the Tehsildar in the year 1974 as appellants belong to Scheduled Tribes as are landless Khatedars. The patta relied upon by the respondent plaintiff does not belong to plot in question.

Heard counsel for appellants.

Issue notice to respondent.

Record has already been received. In the meanwhile, both parties are directed to maintain status quo as to alienation and possession of the suit property as it exists today.
