JUSTICE SUDESH BANSAL Order 03/03/2022 The appellant-plaintiff has preferred this second appeal feeling aggrieved by the judgment dated 16.04.2010 passed by Additional District Judge No.1, Ajmer in civil regular appeal No.97/2006 whereby his civil suit for possession has been dismissed.
It appears from the judgment impugned that before the first appellate Court, the respondent No.2 is "Nagar Parishad, Ajmer" whereas in the present second appeal appellant has impleaded the respondent No.2 as "Urban Improvement Trust, Ajmer". In fact the appeal is required to implead the Ajmer Municipal Corporation as party respondent No.2 in place of Urban Improvement Trust.
The appellant is directed to remove the error pointed out hereinabove within a period of four weeks failing which, appeal shall stand automatically dismissed without further reference to this Court.
