HON'BLE MR. JUSTICE SUDESH BANSAL Order 02/03/2022 The appellant-defendant has preferred this first appeal against the judgment and decree dated 05.12.2020 passed by Additional District and Sessions Judge No.1, Alwar whereby the respondent-plaintiff's suit for recovery of money amounting Rs.1,53,910/- with interest @6% per annum w.e.f. 20.07.2013 has been decreed.

Issue notice to respondents of appeal as well as stay application.

Call for the record.

In the meanwhile, if appellant deposits Rs.1,00,000/- before the trial court within a period of four weeks, the execution of impugned decree shall remain stayed. On deposition of such amount, the same be disbursed to respondent-decree holder on furnishing an undertaking that in case the appellant succeeds in appeal, he shall restitute the amount received by him.
